What is Utility Model?

It is a registered right that recognizes minor improvements or development to an existing invention or product.
Also referred as “petty patent” or “minor invention”
Examples of utility models apply to the functional aspects of toys, watches, machinery, e.t.c.

Who can register?

An inventor or assignee of an invention can apply to register for utility model.

What are the conditions for registration?

  1. The invention must be new and unanticipated.
  2. Industrial applicability – the invention must be useful in any kind of industry.
  3. They must be described in an application in a sufficient and complete manner.

Where can you file an application?

  1. At the national level – all applications must be filed at Business Registrations and Licensing Agency (BRELA)
  2. At the regional level – applications can be filed through African Regional Intellectual Property Organization (ARIPO) either electronically, by email, by courier or in person.

The duration of protection

The duration of protection of utility model in Tanzania is 7 years from the filing date and it’s not renewable after its expiration.
With ARIPO utility model are protected for a period of 10 years from the filing date.
