Trademark Renewal Processes in Tanzania
Trademark registrations are valid for 7 years from the date of filling and may be renewed for a period of 10 years thereafter. Renewing of a mark must be done within one month before the expiration of the registration period or within one month after it. However, if the renewal is submitted late, an additional fee must be paid.
While the law specifies a one month window for renewal, in practice, late renewal/filing can be done at any time before the removal of the mark from the register.
…continued
A declaration of use must be made during the application or renewal of a trademark registration. If the mark has not been used, a statement explaining special circumstances must be provided.
The use of the whole mark is equivalent to the use of any part or series registered under the same proprietor. If the trademark has been used in relation to some but not all goods or services, it is equivalent to the use of closely related goods or services.
Importance of Renewal
Trademark renewal is essential for several reasons:
- Maintaining legal protection: by renewing a mark, a business can maintain its legal protection against Infringement or unauthorized use of the mark by others.
- Avoiding cancellation: failure to renew a mark can result in its cancellation in the Register.
ARK - Protecting the brand: a trademark is a valuable asset that represents a brand’s reputation and goodwill.
